Hosting Terms:

1. You may only use our services for hosting legitimate legal websites.
2. No Local Hosting of videos, audio files, or executable downloads, that are not owned by you.
3. No websites that host stolen/illegal/copyright software, videos, or pictures  will be hosted with us.
4. Websites that use excessive resources that cause the server to slow shall be investigated and suspended.
5. Using our Hosting as a "online backup" shall result in your account being suspended.
6. No sites that promote terrorism, or any website that threatens the United States of America will be hosted. If any site promotes terrorism against the United States of America, your site, and client information WILL be handed over to the Department of Homeland Security.
7. Clients that refuse to follow our terms of service shall be suspended.
8. Being Abusive to support shall result in your requests being handled by management, which will slow down your support requests.
9. We will work with our clients to provide the best uptime as possible, however remember this is a shared server and other clients of ours may cause problems, with that we will do our best to resolve the issues with the server to maintain the best uptime as possible.
10. All clients shall pay for services in advance. 
11. We can and will check information of clients against fraud databases and geoip checks to verify that a client is within the scope of ip address and physical address to verify identity. If Needs be we will call the client to verify their identity.
12. Clients may be refused banned/suspended for provided false contact information.
13. Backups are made by cpanel on a daily basis, and weekly basis, if there is an issue with a backup that you are attempting to use, please note that is is your responsibility to maintain off site backups of your data and databases.
14. We can change and edit this section of the Terms of Service at any given time with or without notice to you the client.

Affiliate Terms:

1. Any Person may choose to become an affiliate to our Web hosting service.
2. Clicking your own affiliate link to receive referrals for purchases from Panache Web Ventures will nullify that affiliate referral.
3. All affiliate payments are paid after the client has been hosting with us for 90 days (3 months).
4. Affiliate earnings can be transfered to use for Hosting services only.
5. No person may have more then 1 account with Panache Web Ventures for the use of capturing referrals.
6. Use of the Affiliate websites option is available to hosting customers.
7. Affiliate levels are single tier only. This creates a direct relationship between our affiliate and ourselves.

Website Managment Terms:

1. Website management only includes what is listed for that exact product, and no other item.
2. The following are excluded from ALL website management: Any Data entry, minor or major software installs, portal component and module installs, and integration. This only includes current software that is installed into any portal software that requires a basic update.
3. Website management is designed to provide basic service to a website and only provide the client with the ease of running their website without having to deal with the technical aspects of things.
4. Payments are for 1 month in advance.
   

Refund/charge back Policy:

1. No refund is given on setup fee, unless service has not been rendered.
2. Any charge back by a client will result in their account being suspended. Any requests for any files will result in a $50 recovery fee as well as full payment to restore the account.
3. No refunds shall be given unless no, service is rendered.
4. Service shall be defined as having login access to the account, logging in once, uploading files, or installing software.

Uptime Policy:

1. Our uptime policy is 99.5% uptime per month.
2. Our max downtime that we accept per month is based on the following calculations:

3. If our monthly downtime drops below 99.5% in a given month we shall give a 10% credit towards the next months hosting fee.  If a client has paid by year then the fee shall be a max of $3 off their yearly fee.
4. This uptime guarantee does not apply to sub domain hosting accounts or any other product that does not use a standard domain hosting method.
   

Subdomain Hosting Policy:

1. The setup fee is non refundable.
2. Uptime guarantees are not valid with this type of hosting.
3. The Standard Hosting Terms Apply.
4. Subdomain Clients will not be accepted to the affiliate program unless they have a regular hosting account.

Design Policy:

1. Before start of work, a clear layout and design must be organized, and what software if any will be used for the template.
2. Clients must pay 50% of the Fees before work will be started.
3. No refunds will be given on the first 50% of the work, if a customer is not pleased.

Additional Services Policy:

1. All services shall be billed in advance.
2. There are no refunds on additional services.
